| As a legal concept the right to privacy has existed for not more than a century.The purpose of its existence is to protect natural person's peaceful living and spiritual freedom,to safegard human dignity and to embody human value.In modern society,the right to privacy has been getting more and more important with its legal status ascending from a kind of basic civil rights to constitutional rights and to a kind of human rights.With more and more complicated social life ,the rapid development of science and technology and the formation of web information,however,the privacy is easier and easier to be exposed,spied on and collected.The legal protecton for the right to privacy has never been such a big challenge.In China the situation of legal protection for the right to privacy is far from optimistic due to the lateness of introduction.In practice the influence of traditional ideas makes people unable fully understand it.Hence more and more privacy cases are rising and the kind of tort varies.More and more people are appealing for privacy protection.China,however,has not regarded the right to privacy as a kind of seperate civil rights.The privacy cases have been mixed up with reputation cases.The scope of privacy protection has been limited.Other stipulations concerning privacy protection can not work together with each other.Privacy legislation in China obviously falls behind.Based on this understanding,the author studies on the right to privacy in order to make some progress in China's privacy protection.The thesis firstly makes some exploration in the basic theory of the right to privacy and uses some case methods to make it more clearly.Secondly,the thesis uses the method of comparison to analyze the birth and development of the right to privacy in various countries.Thirdly,the thesis collects materials concerning privacy protection from the Constitutin,the General Principle of Civil Law and judicial interpretations.Lastly,the author makes a conclusion and sets forth some views and suggestions.The thesis consists of four chapters as follows.The first chapter is concerning the basic theory of privacy including the concept of the... |
