On Crimes Committed By Units Of The Penalty Applicable

A brief statement of the text: Nowadays, the percentage of crimes committed by units in Shanghai has been on a rise, especially in economic areas. Therefore, the problems we are facing today, both in theory and in practice, are how to deal with the facts and restrain this sort of crimes. In fact, the criminals sometimes manage to circumvent the law due to the problems and missing parts of the law. From the author's view, punishments on guilty units play a vital part in punishing these units due to their exclusive functions. Despite the fact that these punishments have many limitations, we should ultimately turn to comprehensive regulations and the improvement of the market economy, they do have an exclusive effect on keeping these crimes within limits, inculcating and punishing these units and compensating for the undermined society. The research for these punishments is therefore significant and necessary in reality. In this thesis, the author tries to make a tentative research by analyzing some practical issues and difficult points while applying the related laws. He also gets to the heart of the problems related to the framework of the punishments and the criteria for them, suggesting that the guilty unit be published just as a guilty person, a wider range of related laws be enacted, single-punishments and double- punishments be applied at one time and competence punishment be legislated on the persons in these guilty units. At last, the author airs his views on how to set up the framework of punishment on guilty units.
