On Construction Works Of Nature, Scope And Perfection Of Relevant Legislation

Architectural works is protected by most of countrys's copyright law.As far as 2001 architectural works is protected by copyright law in our country.It is a problem which worthwhile to study and discussion.To study this problem is magnitude and far-reaching meaning on architectural works.Architectural works is limited in tasting building in Chinese legal system.but architectural works is consist of building, ,architectural plan or drawing and building model. at least in many countrys..It is not clear distinguished the nature and ranges of architectural works of chinese copyright law.,and this article mainly discusses the nature and ranges of architectural works,and raise the suggestion on our legal system of copyright law.The full text altogether divides four parts。A concepts of architectural works and the features of copyright between architectural works is made in the first part,where the relation between architectural works and copyright works is discussed.Then analyzed the nature of architectural works in the second part,From the analysis of anchitectural works we can find a conclusion that architectural works should separate from art works.The ranges of architectural works is discussed in the third part,based on the analysis ,a conclusion is reached that architectural works including building,architectural plan or drawing,including the overall form as well as the arrangement and composition of space and elements in the design ,including building model.In the final part,posing the deficiency and shortcoming of our legal system of architectural works,as well as raise the suggestion on consummate our legal system of copyright law.
