Legal System Standardization Study

By the emphasis on'Members shall ensure that technical regulations are not prepared, adopted or applied with a view to or with the effect of creating unnecessary obstacles to international trade', WTO/TBT admit that the existence of technical barriers to trade is reasonable and necessary, allow the members to establish the technical code and standards which are different from other countries. Conforming to the tide of global economy and economic setup reform, many countries look on standardization as the tool to the new technology and market; constitute their own standardization rule of law system and strategic policy to chase each other for the leading position on the global standardization contest. The standard becomes the central key factor in global economy contest. The contest on standard is the contest on future products, market and national economic interest.The developing form and action of the standard is getting deep and broad effect on the economy, law and technology. It provides new proposition to correlative law system. How define the nowadays standard? Will the international standard becomes one of the international law's sources? What is the role of the standard in the national law system? How assort the stability of the law with the flexibility of the standard which according to the rapid development of the science and technology? Who is permitted to establish the standard? How control the standard's negative action on unjust competition and monopolization by law?
