| Trade secret is unknown publicly information which is of practical use and great value and can bring economical profit to oblige. In market competition, trade secret can bring its holder great profit and potential competitive advantages, and it is vital for an enterprise to hold it. The outstanding features are confidentiality , so it is not only the trade secret holder's biggest wish but demand of market that trade secret be well protected. Loss of trade secret is caused by flow of talented persons while prohibition of competition is a useful way to solve the problem. The text is intended to discuss the relation between protection of trade secret and prohibition of competition. The whole text is divided into the following six sections:Section 1 mainly discusses the concept and scope of trade secret as well as the essential elements of trade secret and legal characteristics.Section 2 mainly deals with the legal consequences caused by loss of trade secret. Meanwhile this section discusses the employees' influence on loss of trade secret and put forward the subject of prohibition of competition.Section 3 mainly makes an analysis of prohibition of competition by discussing its concept, features, classification and subjects and so on.Section 4 mainly discusses prohibition of competition in protection of trade secret, the conflict of prohibition of competition and the rights of labor forces and the legislation of our country on prohibition of competition in protection of trade secret.Section 5 mainly discusses the validity of prohibition of competition, including the competition prohibition contract and its legal enforcement and the legal responsibilities in breach of it, especially the regulations of our country.Section 6 mainly talks about the existing conditions of our country, analyzing the defects during the protection of trade secret and putting forward suggestions on it, that's to reinforce the legislation about it. |
