| For a long period the news about illegal and criminal gambling activities are frequently seen in the papers, involving increasingly new means.unceasingly growing participants ,ever-expanding gambled amounts,increasingly added actions of leaving the country for gambling abroad and ever-acute crimes rising from gambling by taking advantage of duty, which have raised the attention of people from different circles. . In the words by some scholars,nowadays it' s in a banging time with gamblings,which have become a global issue. For the gambling, the nations take various attitudes such as openly allowing it, and only banning unlawful gambling actions though their provisions of gambling crimes in criminal laws. In 1997 Chinese Criminal Law stipulated three means of action including opening gambling houses, gathering a crowd for gambling and making a living on gambling. With the development of society, the tricks of gambling are continously changing,which involve more and more things and have had growing negative effects. Only depending on the regulations about gambling crimes in the criminal law,cannot satisfy the actual needs for fighting with the crimes and therefore related legislations must be improved. Declaring different crimes for above three means of action;declaring an independent crime with the actions of network gambling,issuing and selling lottery tickets illegally;increasing units as gambling crimes' subject; adjusting criminal punishments according to different gambling crimes, with punishment and responsibility suiting to crime;making full use of the pecuniary penalty and defining its range. |
