In china, the business license is the legal certificate that an enterprise should obtain first if it enters the market. Only when an enterprise obtains the business license, can it be engaged in the bargain activity with legal corpus entity. At the same time, the business license is the most common means used by the register office in the organization management. The office usually revokes the business license of those enterprises that violate the law to standardize and legalize the market order. However, because the nature of the business license and the legal consequence caused by the revocation of the business license are not specialized, some creditors don't know whom they should indict. What's more, some enterprises even want to evade their debts intentionally through the revocation of its business license, which seriously harm the creditor's and its shareholder's legal rights and profits. So, it is very significant both in theory and practice to do researches on the revocation of the business license.In this paper, the author attempts to explore the legal problems caused by the revocation of the business license from five perspectives. The first part is focused on the legal consequences caused by the revocation of the business license of an enterprise. The author first introduces the nature of the business license, and argues that the business license of an enterprise is the evidence of its qualification for operation. Then, on the basis of the analysis of different viewpoints upon the legal consequences caused by the revocation of the business license of an enterprise, the author holds that the revocation is the deprivation of its qualification for operation, but its qualification for being a legal person. The second part is focused on the legal status of an enterprise after the revocation of its business license, which is analyzed from three aspects, that is, the civil corpus status, the civil litigation status and the civil obligations.
