Abuse Of Intellectual Property System Study

In our country, the history of the intellectual property law is comparatively transitory. In the last 10 or 20 years, we have great-achieved successes, but in the situation of economical globalization and knowledge economy at hand, we are facing the necessitous problem of consummate the system of intellectual property law, and we also need to upgrade the people's legal consciousness of intellectual property. On the other hand, the legal system of preventing the abuse of the intellectual property and confining the monopolization on the intellectual property is still not really made. Although the monopolization on the intellectual property is not quite stands out, there is still the possibility of the monopolization's spreading in the situation that the trend of economical globalization and knowledge economy is going on expanding. How to prevent the abuse of the intellectual property and how to confine the monopolization on the intellectual property is a necessitous problem we are facing.To preserve the order of the market competition in effect and to develop the national economy, it is necessary to set and consummate the legal system of the antitrust law to control the intellectual property. The antitrust problem on the intellectual property is very complex; it's hard to discuss the problem full-scale. In the paper, I only to analysis the problem in the macro-perspective, and bring up some suggestions on setting the legal system of the antitrust law on the abuse of the intellectual property by sum the experiences from other countries and areas.The paper is divided into five parts, and the first part is to deals with the justifiability of the intellectual property.
