On The Court Of Public Policy Formation Function

Comparing with the ancient court, the modern court has outstanding political function. The modern court has moved towards the front desk from the backstage supporter of the national affairs gradually. Through inquiring the specific cases and making judgments on concerning political actions, courts have the political functions of supervising the system of state, limiting the power of government, marinating the system of constitutionalism, forming public policies and administering diplomatic policies, etc.This article has introduced the practice and development of Miranda Warning in U.S.A, through the three case happened in the three different periods: Warren court period, Burger court period , Rehnquist court period.The aim of the article is to announce the importance of the court's public policy form function.The body of the article is divided into three parts. It begins with the production of Miranda Warning and the development of Miranda Warning, which gives the reader a direct impression of the court's public policy form function to the American society. The second part is written to analyze and discuss this function of the court in theory, including its importance and its requirement formed .The last part of this article is written to introduce the lose of the Chinese court's public policy form function and attempt to find a way to solve this problem.
