National Legal Culture And The Construction Of A Harmonious Society

The Communist Party of China 16 sessions of four COP plenary conferences "Decision" to propose "Constructing socialism harmonious society" theroy is the good approach to deal with kinds of society conflicts in the times of social transition. Usuallily, we can see the theory backgoud is from modernization experince, that is, by the top-down model of institutional reformation, to establish the harmonious society. But this paper will tell us another thought culture resource which we could not gorget in constructingharmonious society--traditional customary law of ethnic minority formingfrom the folk society. Realizing any the social ideal, human beings can not rever historial traditon, and the approach to the status of harmonious society have had deep history implication and rich culture intension. In the the pattern of "pluralistic integration" in the the Chinese nation, we must sufficiently repect ethnic minority culture and traditional customary law of ethnic minority which is the "sub-culture" of it.In deed of politics, there are a lot of researches of society harmony issue in academia. But writings which connect with Chinese ancient culture property are not many, and there are few special writings in relation to absorbing traditional culture of minority. In the other side, in the recent years, it have appeared plenty of materials, writings and controversies about folk laws. But few of these are in the visual angle of harmonious society theory. The innovation of this paper are as follows:not only do make up for the absence of attetion to history and folk tradition, but also on the basis of research achievements of customary law of ethnic minority, in the distinctive visual angle of paying attention to harmonious society, it deeply excavate and analyze folk legal laws , which have existed in diachronic minority communities, and their operation situation.
