Study Of The Guardianship System

The purpose of this paper is to consummate the custody system in our country. By comparative research of the two legal system, we want to get the new idea, intent of development and content of guardianship. By comparison, we anaylze the limitation and shortage of our custody legislation and advance the legislative idea.The penman consider that we should assimilate other country's lawmaking idea and concrete regulation. In young person's custody aspect, parental custody and non-parental custody both should be set up; In adult's custody aspect, we should establish both legal and free guardianship. We should also speculate the rights of guardian, the guardian's qualification to fill our lawmaking blank, consummate supervision system and safeguard system.
