| Criminal appeal system in china growing out of nothing is becoming more complex than its preliminary stage, and overcoming its shortcomings to consummate itself. The process has also seen the advancement of human rights protection. But the speriority it has displayed can not conceal the questions and flaws. The first part of this thesis analyses the questions of the scope, juridiction, reasons of appeals and time limit to appeal and examination, then gives the suggestions. The second part concentrates on the procedure for the prosecute to review appeal cases and what they should attend to. Public hearing system and compulsory answer rules are also discussed in this part. In the last part, penman suggests to perfect our lawsuit rectifying-system as long-term object. According to the principle of "no advantage no lawsuit" and taking parties'appeal as center, we should reconstruct our criminal retrial system. Finally, suggestions are given to reduce the number of appeals, Which includes reforming present judicial system, setting up simplified three trials in final, keeping appeal courts under more strict survey to improve the accuracy rate of judicial decisions. |
