We should pay much attention to the rural people's endowment insurance, but the legislation about it developed further slowly than the increasing demand of the rural people. So it is necessary for us to have a research about the legislation of this problem.The rural social endowment insurance is a system created for the rural people to protect them from the old-aged risks. The rural social endowment insurance rules are the sum of the rules regulating all the legal relationships in this field. On one side, they set that the individual has the right to gain the legal property from one's nation: on the other hand, they set that what the nation and the government owe to their people. The nowadays rural social endowment insurance shows different characteristics from the cities, and so the rules, because the rural areas and the cities in China are so different from each other. The law is a brunch of the economic law and it is in the social law field. It has much the same as the insurance law. but more difference. From these sides, the writer analyzed the status of this law.From the beginning, the rules experienced several periods. In the writer's view, the rules will be in construction for a long time. In the end of 2004, the amount of the people who joined the rural social endowment insurance in China had arrived at 5378000, about 2050000 people got the old-aged pension all together, and the amount of the fund had been up to 285 billion Yuan.Many developed countries have established the rural social endowment insurance rules. According to some statistics, at least 70 nations of the districts have put the rural people into their protection scopes. The writer took Japan, Poland and France for example, introducing the relevant systems in these three nations. And then we can learn from it. Firstly, statutes are good forms to consolidate a system. Secondly, the first kind of the people who should get insurance in rural areas are peasants. Thirdly, the government shall pay for it when some conditions could be satisfied.
