This dissertation is the research of unit recidivist on theory. our country established the unit crime system in 1997's criminal code. Along with the establishment of unit crime in legislation and its existence in practice, unit recidivist appeared .In the last few years, the scholars have carried on a research of unit recidivist on theory and practice, putting forward a lot of original viewes. Based on scholars' data and standpoint with the theory analysis, I think that the current penal code of our country have no unit recidivist's provision, but the unit recidivist may exist theoretically, then the dissertation elaborates the conditions to constitute unit recidivist, punishment and suggestions to the criminal legislation in detail.In addition to the preface and conclusion, this dissertation is made up of five chapters. Chapter 1 is the scholar's standpoint of unit recidivist. Chapter 2 is about the analysis of the unit recidivist on theory. Chapter 3 is the conditions to constitute unit recidivist and Chapter 4 is the punishment of the unit recidivist. The last chapter is about the suggestion on the unit recidivist and some notices on settling it.Chapter 1 is divided into three sections. The first and second section is about the two kinds of standpoints on whether unit recidivist exists or not, then, the third section supports the negation 's standpoint and gives some other reasons of it.Chapter 2 is divided into three sections. Section 1 demonstrates the possibility to establish the unit recidivist, Including the unit crime system to lay foundation for the unit recidivist etc. Section 2 is about the necessity of the unit recidivist from the objective fact of the unit committing crime again etc. Then section 3 analyzes the unit recidivist's theory basis and the scope of existence.Chapter 3 and chapter 4 is to establish the unit recidivist on theory from the conditions to constitute unit recidivist and the punishment principle and method of it. Chapter 5 puts forward the unit recidivist's suggestions on the unit recidivist and a few special problems about it.
