Administrative Authority

According to the legal principle theory of the administrative law in our country, usually " the authorization empowered from the legal laws and regulations " directly will equate to the authorization empowered from the administration. But the true significance of the authorization empowered from the administration, namely "the shift of the administrative authority ", will not be paid much attention by our scholars. In fact, "the shift of the administrative authority " in the administrative activities widely exists to the public administration practice in our country. Although the legal principle theory of the administrative lawwill be studied in different angles in different countries, there is a census in different countries that the authorization empowered from the administration has played greater role in the modern administrative activities.Based on the big background of the constitutional government construction and the public administration reform, the author make deep research on the authorization empowered from the administration with the method of comparison, which makes a comparison from the administrative authority between the administrative organizations, namely the shift of the administrative authority in the angle of view. The author also investigates the administrative authorization.This article systematically has carried on the thorough inspection to the reality and the theory in various countries' administrative authorizations for the first time, which not only had proven that the forms of the authorization empowered from the administration in the practice exist widely and but also has pointed out that the reality and the theory in various countries' administrative authorizations has different situation under the method of comparison.
