With the popularization of personal computers, more and more computers have been being applied to enterprises, institutions, schools, families and personal lives. Just because the use of computers closely combines with our lives, we have been becoming more and more dependent on the software which is indispensable to computers. Computer programs usually have two forms: program's object codes and program's source codes. The rights of traditional commercial software such as modification, copy, translation, re-issuance, etc. are kept from its consumers by closing the source codes of software. The retention of these rights deprives the software's users of the ways in which the software will be used more independently and efficiently. In order to resolve the problems that closing of source codes of traditional commercial software brings inconvenience to the users, and obliterates the spirits of freedom and cooperation of mankind, the open source software came into being. After the naissance of the open source software, it rapidly spreads from the small-scaled cooperative experiment between several programmers to large-scaled or even commercial operation among countries, and it grows up swiftly.The appearance of open source software has great theoretical and practical significance. In theory, because the rules, ideas, development and operation modes of open source software are completely deferent from those of traditional commercial software, it decides that the choice of the protection mode of it is different from the choice of protection mode of traditional software, and its special protection mode forms an concussion in great extent to our current intellectual property protection mode. In practice, the naissance and development of open source software provide a good opportunity for the developing countries and less developed countries to develop their own software industries, which have been enslaved to the developed countries for a long time.
