On Criminal Law Protection Of The Right To Life

The right to life refers to who owns the right of handling and arranging his or her life himself or herself which mustn't be deprived by any of others who include the state, organization and others except for being consented by the human being of it. The right to life is the most fundamental and important right. It is most important value to protect the right to life for the law. Criminal law is one part of the most important system to protect the right to life. It does it to mainly depend on confirming that intentional and slipping action which encroaches on the right to life else is the crime, while it also acknowledges that it is a right to protecting the lives for the citizen himself or herself on certain conditions. Of course, it is a main way to abolish the death penalty for protecting the right to life. The thesis includes three parts.In the first part, it mainly inquires into the position and internal meanings of the right to life. In the problem on internal meanings of the right to life, the thesis mainly researches into the content of the right to life, while studies standards of the beginning and end of lives and according to characteristics of criminal law puts forward the standard in criminal law meanings. In the problem on the position of the right to life, the thesis mainly investigates into the clauses of the right to life as the most fundamental human being right.In the second part, it discusses fundamental principles to protect the right to life for criminal law. At the same time, it also involves importance, fundamental principles and embodiments of criminal law to protect the right to life. In this part, the thesis mainly researches into internal meanings and fundamental request of the principles the equality of the right to life and live supremacy as well as defect in the legislation of our criminal law.In the last part, it researches into several problems to protect the right to life for criminal law. These problems mainly contains ones of helping others to commit suicide and the death penalty.
