Improve The Forensic System Thinking

The current judicial expertise system doesn't serve the ideal of judicial justice well due to its flaws. This thesis, which comprises 30,000 words and falls into five sections, makes an attempt on its perfection and puts forward some new ideas and advices.Section One: Introduction. This section intends to define judicial expertise and its functions.Section Two: Comparison of and analysis on the judicial expertise systems of the two major legal genealogies. To use as reference to the perfection of China's judicial expertise system, this section compares the judicial expertise systems of the Continental legal genealogy and its Anglo-American counterpart, and reviews their advantages and disadvantages respectively.Section Three: The flaws of China's current judicial expertise system. This section focuses on the problems that exist in the administration and procedures of China's current judicial expertise system.Section Four: The necessity and aims of the perfection of China's current judicial expertise system. This section compounds on the necessity to the perfection of China's current judicial expertise system and set forth aims as justice, efficiency and reasonability.Section Five: The perfection of necessity and aims of the perfection of China's current judicial expertise system. This section is the most significant one in this thesis and covers the legislation, administration, procedures, evidences and legal responsibilities in judicial expertise system. As a conclusion, the author puts forward cures as the separation of experts from expert center, the application by the parties, the decision power of judge, random selection of experts, supervision of the expert center, rules on the expert testimony, strict legal responsibilities, etc.
