Privacy Value Of Care And Legal Protection

With the development of the social science and technology and the advancement of the democracy and the rule of law, the right to privacy has become a new and important human right in the modern society. From the view of the process of the human evaluation, the privacy is an innate and objective existence, and the privacy idea is human attitude towards their privacy after the human breaks away from the animal, while the right to privacy is a new human right during the development of society and the change of culture. Although the right to privacy only has more than one hundred years history, it is one of more disputable rights in the right system. Nevertheless, the right to privacy has been protected by the laws of different countries all over the world because of its unique value care for human. However, due to the historical culture and the modern political and economy and so on, the protection level of the right to privacy in our country is far behind the western countries. For this reason, this thesis begins with the basic theories of the right to privacy. And then the thesis proves its humane value care for modern people on the foundation of its theories. And through the comparative study on the legal protection systems of the right to privacy, the thesis dissects a great deal of existing predicaments during legal enforcement in our country and analyzes deep-seated reasons for them. At last, the author pointedly put forward a series of the legal protection systems of right to privacy in order to construct the legal system of right to privacy with Chinese characteristics.
