The relations of the procuratorial authority and the police agency is the basic of the criminal procedure. Chinese criminal litigation developped important functions in punishing crimes.There are,however,s6me defects in Chinese criminal litigation system.A more rational relationship between the procuratorial authority and the police agency should be established. We should reform the criminal litigation system to rebuild the relation of the procuratorial authority and the police organs.
