Study Of Administrative Licensing Procedures

《The Law on Administrative Admission of China》 provides a reasonable and standardized basis for the administrative admission practices, which has been in great disorder for a long period of time in this country. Moreover, the procedural rules of administrative admission settled by the law will promote constant progresses on the theory and practice of administrative procedure in China. While the Law has been put into practice for more than one year, the shortcomings of its structure designation on administrative admission procedure have been gradually revealed. Base on the study of theories and practices of the administrative procedures home and broad, together with the practices carried out on my own, I will particularly discuss in this thesis the administrative admission procedure of our country, expecting to make a little contributions to the improvement of administrative admission procedure and the legislation of 《The Law on Administrative Procedures》 in China.My thesis is divided into five chapters. Chapter One is the summary of the administrative admission procedure, introducing the meaning, value and function of it and its statues quo in foreign countries. Chapter Two is the basic principles of the administrative admission procedure, explaining the internal relations between the administrative admission procedure and the administrative procedure, as well as the relations between its procedural principles and its practical principles, defining five basic principles of it as open, justice, participation, efficiency and convenience. Chapter Three is the basic system of the administration admission, discussing about five basic systems including announcement, hearing, avoidance, expiration and agent, which correspondingly match the five basic principles. Chapter Four is the introduction of the structure of the administrative admission procedure, including the general procedure and the special procedure. Chapter Five is the shortcomings and improvements of current structure designation on administrative admission procedure, especially the shortcomings and improvement of the systems of announcement and hearing.
