Research Equipment Procurement Contract Issues

Equipment purchase contract system is the core of equipment purchase system. In China there are two problems in equipment purchase contract system: one is the nonstandard behaviors on the part of the contract parties, i.e. the customer and the contractor; the other lies in the carrying out of the purchase system. The two problems are preventing the effective running of our country's equipment purchase contract. Solving the problems through establishing general system guarantee and legal system guarantee for running equipment purchase contract plays a very important role in promoting the efficiency and benefit of army-oriented equipment purchase and perfecting its administrative system under the circumstances of socialist market economy.This thesis makes a relatively systematic study in establishing general system guarantee and legal system guarantee for running equipment purchase contract. In the process of study, the thesis employs such scientific methods as comparison, generalization and analogy, combining the knowledge of applied economics of national defense, equipment purchase theories, basic contract theories and law theories. And the thesis draws some conclusions of reference value for innovating our country's equipment purchase contract system.The thesis includes four chapters, apart from "Introduction" and "Conclusion", illustrating two central ideas. First, the thesis analyzes the present conditions of equipment purchase contract in market economy, and recalls as well as envisions the administration of equipment purchase contract; then the thesis analyzes in detail the main problems in the running of our country's present equipment purchase contract from the perspective of modern contract theories. The analysis lays a good foundation for the second part that discusses the establishment of general system guarantee and legal system guarantee. In the second part, the thesis analyzes the present conditions and existing problems in the PLA equipment purchase contract. Based on the analysis, the thesis suggests some strategies for solving the problems in establishing general system guarantee and legal system guarantee for running equipment purchase contract. The thesis concludes that general system guarantee is the basis and legal system guarantee is the core.
