Government Executive Powers To Effectively Control The System Construction

Administrative rights are the most important state power that the Constitution and the laws entrust to the state administration to regulate the political, economical and social affairs. State administrative rights emerged with the appearance of the human society. Closely connected with the personal benefits of the citizens, the administrative rights not only promote human well-being, but also are the state power which is easies(?) to be abused, having the inherent weakness of unlimited expansion, being free of restraint and easy to alienate, just like the monster "Leviathan" created by Hobbes. There are more and more concern and research made by the scholars in related fields on how to keep the administrative rights of the government under the control of the laws to protect the civil rights. Beginning with the reform of the Administrative institution of examination and approval as well as the implement of The Administrative Permission, this thesis is intended to form the effective control system of the administrative rights of the government from a macroscopic point of view, by means of the comparative study on the theory and practice of the control of state administrative rights in the western world and ancient Chinese society, especially through the discussion on the transformation of the governmental function.
