| Personal individual proprietorship enterprise, which has an irreplaceable function in the market economy, is an important part of modern enterprise system. Market economy is the economy governed by law. We must make the personal individual proprietorship enterprise law perfect in order to develop the market economy in China. Starting from the legal position of personal individual proprietorship enterprise and the general situation of the legal system of the personal individual proprietorship enterprise in Western countries, this thesis systematically discusses the characteristics, the contents and the defects of our legal system of the personal individual proprietorship enterprise by means of comparing our law with the Western law. The thesis expounds the legal issues in regard to personal individual proprietorship enterprise, including the capital system, the qualification of the investor, management of business, amortization, succession, dissolution, liquidation, etc, and points out the shortcomings about the credit, financing, liquidity, the protection from the criminal law, and so on.
