On Special Protection Of Well - Known Trademarks

The aim of this thesis for the master degree is to study the problem of special protection for the well-known trademark.It begins from analyzing the concept and character of the well-known trademark , the agency , the validity and the significance of recognizing the well-known trademark . Then it studys the international onventions of special protection for the well-known trademark and the system of other countries for the protection. With researching the defects of our country in the protection of the well-known trademark, the thesis puts forward a few suggestions to improve the level of protection for the well-known trademark in China. This thesis is composed of three sections ---the foreword ﹑ the text ﹑ the conclusion. In the foreword, it outlines the significance of protection for the well-known trademark through studying the value of well-known trademark firstly.Then, it explains the necessity for improving the level of protection for the well-known trademark in our country by observing the present conditions. In the text, the first chapter is to introduce the concept of the well-known trademark and the importance of protection for the well-known trademark.The second chapter is to study the international development of protection for the well-known trademark through analyzing the Paris Convention,the Agreement on Trade Related Aspects of Intellectual Property Rights,the Joint Recommendation Concerning Provisions on the Protection of Well-Known Marks;The third chapter is to demonstrate the efficacy and significance of the cognizance of the well-known trademark by analyzing the agency and standard of recognizing it.The forth chapter is to study the feasibility to absorb the American theory about the dilution of famous marks to improve the level of protection for the well-known trademark in our country by studying the theory of dilution of famous marks,the international influence of the theory of dilution of famous marks,the dilution of domain name of internet to famous marks.The fifth chapter is to introduce briefly the development of protection for the well-known trademark in our country. In the sixth chapter,there are some suggestions to legislate and modify the regulations on protection of the well-known trademark after analyzing the reality about this in China. The conclusion is a summary about the development of protection for the well-known trademark in other countries and China.At last,it generalizes the viewpoints of the thesis to improve the level of protection for the well-known trademark in our country.
