On The Civil Litigation Expenses

This paper is on the system of litigation expenses in civil lawsuit. The system of litigation expenses is very important in the course of civil lawsuit. People select justice because they have the belief in its function to safeguard fairness and just, but in judicial practice , the unfair justice has become a serious social phenomenon. There are still some defects in our currunt system of civil litigation expenses, we should reform and restructure the currunt system of litigation expenses. Besides the preface and the conclusion, the paper is divided into four parts. The first part is on introduction of the system of civil litigation expenses. The author discusses the concept and components of litigation expenses, the reason why civil litigation expenses are imposed , the nature of civil litigation expenses, the relationship of litigation costs and litigation expenses, and the burden of civil litigation expenses. The second part is on the history of the system of litigation expenses and the comparison of the system of litigation expenses between the main foreign coutries and our coutries. The third part is on the analysis of the current system of litigation expenses. The author points out some defects of our system of litigation expenses such as the validity of the rules of litigation expenses, the standard of litigation expenses , the renderment of litigation expenses after the lawsuit, litigation expenses should involve the lawyers' fee and the relief of litigation expenses. The fourth part is on the ideas of reforming the system of civil litigation expenses. We should restructure the general principles of litigation expenses, as a result , a regulation of civil litigation expenses should be made by the Congress, and a scientific and complete system of litigation expenses should be established. And it must be a feasible scheme.
