On The Trial Process Management

The preface mainly introduces the core contents of the Trail ProcedureManagement System---trail procedure, defines the trail procedure andsummarizes the origin of the regimes the basic contents, the course of deduce and the development of the condition, clarifies the basic relationships between the Procedure Management and the prosecution laws, it offers proper and integrated illustrations of the Procedure Management and the writing purpose and research methods of this article.The first part, " the value of investigating of the Procedure Management" is to express mainly the Trail Procedure Management and the concept of this regime, the origin and the development, the mechanism of the working. Comparing the patterns and contents of the Procedure Management within the Common Law system, revealing the internal relationships between the regime and the procedure laws. Expounding it is the basic regime of the procedure laws, and the essential means to protect the equity of the justice.The second part, "the earmark of the National Trail Procedure Management" . This part includes three contents. The first content is to study the basic contents of the Procedure Management. The detailed analyses are supposed to deepen comprehension to the NTPM; the second content illustrates the main condition of the NTPM at present and draw a conclusion as well. The third content explains the blemish of the NTPMS, mostly in the area of the legislation. NTPMS is not a tangible law, just a series of regulations under the prosecution laws, or being contained in the others procedure laws; it is not so good in the structure and contents, for example, with out the man of the management, how to distinguish the beginning or termination of management, etc. These go against directing the justice practice.The third part, "the consideration of ameliorating the NTPMS" . Based on the discussion of the first and the second part, this part points out the idea of ameliorating, particularly in adding necessary investment in the phase of the legislation. The author hopes to give the inspiration to the legislation of NTPMS in today's China.
