With the development of times ,decromacy thought of people and the thought of respecting human right ,the legal principle of crime and punishment has already caused the great attention of common people.The legal principle of crime and punishment increases constantly in legislating.Improving day by day in theory , has already become the trend of criminal law development in the modern world .For the modernization of Chinese criminal law and making for the world ,the setting up of legal principle of crime and punishment plays the decisive role . And the stipulating of the legal principle of crime and punishment clearly in our criminal law just offered a legal basis for solving the problem . This text uses my law knowledge and the problem that our country exists in practice of the legislation and justice ,finds its reason and on this basis , puts forward effective solution ,namely , in thought ,we should establish the criminal judicial humanism idea that "people first",confirm the modern judicial thought of protecting human right ; In legislating ,we should perfect legislative technology constantly , improve determinacy , rationality and clear legislating further , in order to impel the legislative content melting extensively , legislative method scientific process ; on the administration of justice ,we should set up balance of criminal judicial power and restriction mechanism ,advance judge's professional construction actively, in order to build the good criminal judicial operation environment , guarantee legal principle of crime and punishment to play its greatest role in the criminal judicial work .
