Predatory Pricing is an important form of price competition, and is also the key regulation point of the antitrust law or anti-unfair competition law all over the world. What is the Predatory Pricing? Why does antitrust law regulate such behavior? How to judge it in practice?This paper will analyze and answer these questions based on the systematical discussion of the legal regulation of Predatory Pricing in antitrust law, and give some advices on how to improve Chinese anti- Predatory pricing legislation. This Paper consists four parts:Begin with the concept and essence of the Predatory Pricing, part one illustrates what is the Predatory Pricing, how statute law regulate this behavior, and also analyzes the reason of regulating Predatory Pricing from the view of economics. In part two, combining with the classical antitrust cases, the author elaborates legal standard of the Predatory Pricing and its development in practice of USA.Part three focuses on the primary standards of judging the Predatory Pricing. One is pricing below cost, another is possibility of cost compensation. It also clarifies how to use these two standards to judging Predatory Pricing in practice.Based on the analyses of Chinese related legislation of anti- Predatory Pricing, the author pointed out the defects of current legislation in part four, and put forward some advices to improve it.
