Judicial psychiatry, namely, legal medical psychiatry, has been developed rapidly in the world for nearly half a century. Judicial psychiatry becomes a subject that is paid great attention to by the world. It advances the human being's hygiene, accelerating legal system evolvement tremendously. Countries developed in economy and scientific technology have both groups of expert and education model, social expert establishment in brain science, psychiatry and judicial psychiatry. China, however, starts the research in this field quite late due to the situation of the country. Medical professionals, legal professionals and the whole society have had unclear understand for a long period, which results in the difficulty in spreading the knowledge to the public. Whereas, with the promptly development of the society, the number of psychopath grows sharply, and consequently, the number of psychopath evolved in crimes rises rapidly. On the other hand, appraisal system that is fit for China has not been set up. And there is no practical rule to follow in appraisal procedure. Worse still, the colony of experienced expert in this field has not been formed. As a result, it is difficult to guarantee the justice while authenticating professional issue under current situation. So, in the long run, China should learn the successful experience from the both Civil law system and Common law system, and set up the appraisal system fit for our own procedural system in order to guarantee the justice. This dissertation has three parts, including around thirty-two thousand words. The first part concerns both the historical developments of the definition of psychopath by medical professionals and the definition of psychopath and the criminal liability of psychopath by legal professionals. The second part analyzes the content, significance and characteristic of judicial psychiatric appraisal, and compares the judicial appraisal system between the Civil law system and Common law system. The last part provides new style censor method and censor form concerning the judicial psychiatric appraisal document and appraisal conclusion, especially in terms of the censor and authentication method when the multiple appraisal conclusions in the same case contradict. And consequently, put forward the proposals concerning the remedy on untruthful appraisal conclusion and how to set up the judicial appraisal system and judicial appraisal sensor system fit for our criminal procedural system.
