On The Perfection Of Legal System Of WTO Rules And China's Foreign Trade And Economic Cooperation

The WTO rules are a set of generally applicable norms for international economic trade. The WTO rules has got the enormous influence to the law of international economic trade between all countries and regions, and also been a behavior standard of the international economic trade activity .It has been agreed upon by China in its entry to WTO agreements that it will fully undertake its obligations in accordance with WTO agreements through the modification of its present laws and regulations as well as codification of new laws . As the organization that our country entered is an international trade organization, what are affected are mainly the laws and regulations related with foreign economic trade, and most of which are concerned with cargo trade ,service trade and trade related intellectual property,trade-related investment measures and relevant administrative,judicial procedures, ect. Through more than twenty years' efforts, China has continuously amplified its laws in the field of foreign trade and economics, when compared with the WTO rules ,there remains a big difference, such as the problems of legislation blank,legal system imperfect ,ect. So how to use the rules of WTO to modify and perfect foreign economic and trade laws has become an important issue in the present Jurisprudence research. This article has been divided into four parts: first,the author makes an introduction of the WTO rules system and an analysis of the system and the influences of China's entry into WTO upon the economic and trade laws of our country; then the author describes the problems existing in China's present economic and trade laws and their causes; thirdly,the author points out the target for perfect our country foreign economic and trade law system and the basic principle that our country foreign economic and trade legislation should follow; finally ,on the basis of a deep understanding of the spirit in the WTO rules and studies on the theoretical research fruits of related experts ,scholars, the author puts forward a theoretical framework for perfection of China's foreign economic and trade law system, trying to achieve innovations and breakthroughs in the theory.
