Ethics Of Judges In The Judicial Process: The Value And Function

The judge's judicatory is a dicey process, different judge aims at same case will usually get a different result. Their judgement need the provision in law surely , on the other hand, it should also be under the subjective control of judge himself. Judge' s ethics is an important aspect to affect the judge. Judge' s ethics is a kind of occupat ion ethics, saying strictly, it develops with the judge's occupation.Textual chapter 1 introduced the judge's ethical concept and characteristics. Judge's ethics is a gross concept of the stable moral, behavior norm and the consuetude, it primarily includes the judge's value and thought in judicial process. It produces from the social ethics , of course it is the same with social ethics on a lot of the most basic aspects; and as a kind of occupation ethics , it should also be with judicial occupation , perform the occupation character of itself.Judicial process is indeterminate, chapter 2 analysed judge's ethics to the judge in judicial process value judgement,Chapter 3 introduced the judge with both parties' communication in the party concerned to knowing judge's ethics method is in the judicial meaning in the process. Be used as value judgement and function method, they contact mutually, the former is the contents of the latter, the latter is a former performance method, both of them will develop the important function in modern judicial process.Chapter 4 put forward the problem of our judge' s ethics and analysed three reasons that resulting in the imperfections.In our country , the present ethical condition in judge's occupation makes a limit to judicatory reform, textual chapter 5 namely regarded judge's ethics as the angle of view, discussed its influence to reform path, litigation mode and the influence of the target fixed position.
