Export Of Labor Law Research

Nowadays, with the influence of economic globalization, the export of labor service is becoming one of the important projects in the area of international service trade. After more than 20 years development, China's export of labor service has become one of the dominant service projects. But compared with some main labor export countries, it still lags behind. So the thesis tries to make a study of the export of labor service from legal point of view and give some beneficial suggestions to it.This thesis is presented in three parts.Part I expounds the definition and the types of the export of labor service, elaborates the objective necessity of the flourishing development of the present export of labor service and further reveals the practical significance of the export labor service for the export countries, the import countries and the global economics. On this basis, the author also analyses the distribution and the tendency of the development of the global labor market.Part II mainly deals with the movement of natural persons in GATS which has much to do with the trade of labor service. This part introduces the stipulations about the movement of natural persons in GATS and the severe interest divergence between the developing countries and the developed countries in this field, analyses the main labor trade barriers which the developed countries place and comments upon the advantages and disadvantages of GATS to the liberalization of the trade of labor service.Part III points out the drawbacks of China's export of labor service and passes on the successful experiences of the main export countries. On this basis, the author gives some suggestions to promote China's export of labor service from legal point of view.
