Wto Copyright Protection

With Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) in World Trade Organization (WTO)going into effect, international copyright protections have been showing a new tendency. During entering into WTO relevant copyright laws also have been revised in China. At the background of China entering into WTO, provision on copyright protection at TRIPS agreement in WTO and significance in copyright protection after China entering into WTO were systematically summarized. Based on TRIPS agreement in WTO, legislation and prosecution adjustment in copyright protection were emphatically researched during China entering into WTO. Legislation adjustment was embodied in revision of copyright law. Object and scope of copyright protection were extended and rights of copyright person and neighboring right person were increased in the new copyright law. Scope of restriction of copyright was lessened and liability was strengthened in the new copyright law. Issues of copyright protection on internet and databases were included. At the same time, administrative and judicial prosecution was strengthened. Aiming at new issues that environment of network put forward to copyright protection, copyright protection issues of internet and databases in relation to environment of network were discussed and copyright protection essentiality of internet and databases in China was clarified. At last, according to present situation in China and developing tendency of WTO, better measures and suggestions were made in this article after China entering into WTO.
