Criminal Fine Study

This essay consists of three parts as following:Part 1: Outline of fine penally. In this part, the author probes into the question of the conception, the characteristics of fine penalty and hold that the pros of the fine penalty is the most important.Part 2: Judicial application of the fine penalty. The author classifies different applicable principles of penal legislation into three legislative models and analyses them one by one. The author expounds his views on juvenile offenders and fine penalty; on recidivists and habitual offenders and fine penalty; on the questions of temporary suspension of fine penalty. Difficulties in execution of fine penalty are common in the whole world, which is concentrated on no payment of fines. The author believes that if we want to overcome difficulties of execution, we have to expand our theoretical fields of vision to the whole operative mechanism of the penalty, adopting an overall strategy of decomposition, and preventing us from concentrating all difficulties in the stage of execution.Part 3: Perfecting in legislation of the fine penalty. Improving position of fine penalty in penal system; perfecting applicable principle of fine penalty; mainly applicated on light crime; perfecting compound fine penalty in legislation.
