Abuse Of Patent Rights And Its Control

We should value the restrict to patent rights when we are enhancing protection of the patent rights to keep patent rights from abusing. There has already the matural way about it abroad and obtain the good result. We can't despise the problem of patent rights abuse both from perfecting patent rights and from promoting the development of economy.This text studies patent rights abusing and its control from three aspects.(1) Make a general analysis of patent rights from its concept, establishment, condition, protection and practice.(2) Analyze the intention, the constitute important document and categories of patent rights abuse.(3) Control patent rights abuse from the principles and methods, especially pay attention to methods.The author wants to find a way to control patent rights abuse from the Patent Law and Antimonopoly Law. The departments concerned must formulate more detailed and more concrete guidebook or regulation. Ultimately we can perfect our country patent system, provide the good environment for the development of the market economy.
