On Divorce Mediation

This paper combines divorce institution with the conciliation procedure. By reviewing the history of the conciliation procedure, it mainly analyzes the present situation and defects of the divorce institution. Meanwhile, it draws on the experience and system of the Western countries with regard to divorce conciliation procedure. Besides, it also points out the necessity and the feasibility of the standardization and institutionalization of the present divorce conciliation, it also units the Chinese situation, brings forward the preliminary assumption which construct Chinese characteristics of the divorce conciliation. Viewing from the method of research, the thesis, which is directed by dialectical materialism and historical materialism, integrates theory elaboration with practice analysis, largely use the method of comparison and historical analysis. From the basis of methodology, it further expatiate the basic theory of divorce conciliation.
