| In 1997 the Criminal Law described in definite terms the crimes of mafia-style organizations in order to accommodate the development of organized crimes,but there are many questions remaining to be solved in criminal law theories and in judicatory practices. This article researches in detail and depth the crimes of gangster-natured organizations from the perspective of the combination of criminal law theories and judicatory practices. The article consists of four chapters. The first chapter defines the meanings of mafia,mafia organization,and mafia-style organization,and emphasizes the juristic characteristics of mafia-style organization. Chapter two explores the judicial cognizance of the crimes of mafia-style organizations;and beginning with the juridical characteristics of gsnsterdom-natured organizations,it investigates the evidential standards and systems from the perspective of juridical cognizance. Chapter three examines the boundaries between the crimes of gsanster-natured organizations and crimes from non-organized groups,hooligan-style organizations,terrorist groups,and organized groups. Chapter four outlines three questions in dealing with the crimes of mafia-related organizations. |
