The interdependent relation between the nation has been deepened. The economy of barter centering on commercial trade and investment has been stridden over the national boundaries. Especially recent years,the direction of international capital current has been changed from one-way out flow to developed countries to two-way convection between developed countries and underdeveloped countries. The new aspect of mutual convection and investment in countries has been taken on. International rate of investment has increased rapidly and exceeded the rate of international investment and became the important economic activity in the world.Since overseas investment deals with a wide range and complicated relations and great risk the acceptor of investment and the exporter and importer of investment and the international society have taken varied ways to reduce its going on smoothly guarantee system for overseas investment is one of the important ways.Guarantee system for overseas investment is a guarantee system that the country which export the capital executes to remedy non-business risk after it happens. By this means,the exporter wants to protect the investment in other countries.Guarantee system for overseas investment is a special assurance system. The main motive to establish this system is to accelerate native private investment to export and strengthen international competitive status by providing non-business risk legal guarantee for native private investment to overseas. Guarantee system for overseas investment includes native insurance and remedy requirement of substitution. That is to say exporter could make investment assurance with native assurance institute when he invests in other countries. If the policyholder suffer damage,he could ask remedy from the native assurance institute according to the contract. Then the native assurance institute could ask remedy from the acceptor of the investment in place of the exporter.Because we do not have any concrete law for guarantee system for overseas investment and it is very complicated and important,especially for promoting Chinese overseas investment,I will discuss the problem in China in this article.
