On The De Facto Marriage

There are some disputes of the concept of de facto marriage and the attitude of the legislation about it for a long time. In our new Marriage Law, the attitude on de facto marriage has changed to relatively refuse to acknowledge it, in contrast to absolutely refusing before. Facing a lot of de facto couples in reality and the transformation, in domain of family all the world, the author shows her own understanding for the concept and offers the suggestion for our legislation about de facto marriage. The article, which includes five parts, about 30,000 words, starts from the concept of de facto marriage, the history and the legislative example of it, at last to the legislative suggestion.The first part: this part begins with the relationship between the institution of marriage and de facto marriage, following puts up the concept of de facto marriage, at the same time differentiates several relative notions.The second part: the existence and the reasons of de facto marriage. This part separately analyzes the reasons and the existence of the ancient and modern de facto marriage.The third part: several countries of regions legislative example.The fourth part: the process of the legislation about de facto marriage in our country.The fifth part: the theoretical supporting and suggestion for the legislation.
