Sino-us Legal Education Research - Discussion On The Reconstruction Of Legal Education

With the advent of the twenty-first century, China has been devoted to the construction of a market economy in a socialist country with the rule of law. The process toward a market-oriented economy along with a politic regime under the spirit of democracy imposes new requirements on it抯 law education in this country. In response, reform is needed as opposed to the course of law education.This paper tries to make an all-round in-depth investigation of the law education both in China and in the United States (hereafter USA) in terms of historic heritage and law culture, etc.. The author attempts to focus on the heritage and blend of law culture, identical the successful experiences and practices on law education in the USA and their implications for China抯 ongoing law education, pursuing a scientific, effective and up-to-date law education pattern.This paper is composed of three sections: The first section applied the methodology of historic comparison analysis between China and the USA on their respective development toward the nationalization and modernization of their law education. With this behind, the author made a discussion about the intrinsic relationship between law education, law culture and law tradition.In the second section, differences were identified as for the respective law education institutions in China and the USA from the angles of characteristics, objectives, teaching methods, course arrangements and the law educationprofession relationship, etc., and then causes behind were tracked followed by weaknesses with China抯 law education.In the last section, a summarization was made on the implication of the law education conducted in the USA to China. Under the spirit of acting in accordance with the scientific laws as well as education laws, suggestions were put forward on the reconstruction of the law education pattern in China.
