The rights and interests of victims in traffic accidents in China sometimes cannot get good protection. Many grass-roots court judge in our country try to safeguard the rights and interests of the victims, but because of all the judge’s understanding of the insurance system is different, on the application of the law are also different. These differences caused by the “connection with different sentence” judicial chaos, in the protection of rights and interests of the victims but also harm the judicial credibility.In this paper, the first part is an introduction to the basic situation of the three cases of choice, including the case introduction, judgment, and introduced the differences on different courts, disputes in court on the basis of summing up the dispute focus.The second part introduces the relevant concept. Analysis of the legislative system of our country insurance positioning of chaos. In this part also for the rest of the related system are introduced, as a reference of perfecting our country’s insurance system, for the specific conclusions.
