Study On The Collective Forest Right In Xiangxi Minority Area From The Perspective Of Customary Law

Our country collective forestland area accounts for more than half of national forestland area, and mostly distributed in the southern ethnic minority areas, ethnic minority areas of the collective forestry in forestry in China occupies an important position,relations of collective forest right system reform in China’s forestry sustainable development, the development of national economy, increasing farmers’ income, and ecological security. In ethnic areas, therefore, the research to the problem of collective forest rights can effectively promote the reform of collective forest right system in our country effectively.Xiangxi area belongs to the national autonomous areas, the regional forest flourish, and collective forest area accounted for about seventy percent of the territorial area, xiangxi region collective forestry development can better reflect the collective forestry development of the ethnic minority areas in our country. Therefore, this article first to the common law and forest ownership of related basic theory are discussed, and then based on the studies of xiangxi area, by introducing the xiangxi area forest resources situation and development course of collective forest rights system, analyzing the collective forest right system reform, less found xiangxi region still exist the masses to participate in the reform, the forest rights dispute, conflict, the franchise expanded and ecological protection forestry development level is not high, the problem such as the farmers’ income increase is not big. In presents each national customary law and certainly xiangxi area with ecological protection concept, to standardize the behavior of forestry of the local people, protect forest resources and ecological environment, make up for the national law system of regulating the weak positive role at the same time, analyzes the collective forestry should be the pursuit of the value of the west region, and puts forward relevant system from the Angle of the common law concerns.In xiangxi area for the foundation, from the Angle of law, to explore China’s minority nationalities’ customary laws in the ethnic areas the influence and function of the system of collective forest rights, hope you can find the collective forestry system reform in national regions of the road of innovation, fully absorb the reasonable core of the minority nationalities’ customary laws, develop to the road of the development of the collective forestry system in national regions, guarantee of collective forestry sustainable development in national regions, promote economic development and increasing farmers’ income, to maintain ecological security.
