Research On The Legal System Of Providing For The Aged In China In The Transitional Period

An aging population,as a kind of the economic and social phenomenon,is the economic and social development to a certain stage inevitable product. The aging population not only affects everyone in society who goes through from the young to the aging process,but also has a huge effect on the economic and social development.However, the proportion of the elderly population is rising,means that the ability of value creation of the whole society would be decreasing.Therefore, the governments around the world are working hard to find ways and take measures to actively cope with the growing of the negative effects of aging population,and upgrade the service level for the aged,protect their lawful rights.Countries all over the world are exploring in practice. Many developed countries regulate the legal relationship of social pension in the form of legislation and constantly improve. However, the level of construction about the legal system of social pension in China is relatively low. Under the background of constructing people-oriented and harmonious socialist society and promoting the peaceful rise of China, it is significant for our countries’ whole legal construction to analyze the present situation of Chinese pension ’ s legal system and improve the law correspondingly. This thesis chooses this hot topic and hopes to combine with theoretical knowledge to make a simple analysis of Chinese pension law system from the perspective of practice, to explore the problems in reality and to make a suggestion to improve the present pension law system correspondingly.From the overall structure, this thesis is divided into three parts: introduction, text and conclusion. The main content is as follows: the part of introduction is to introduce the international trend of the present social elderly care, the aging situation which our countries is facing and the situation of China’s current pension legal system in order to the research object-the exploration of improving Chinese pension legal system. The body part is divided into four aspects:Our country’s specific features of the aging of the population in transition;the function of the family pension mode is weakening;how to perfect our legal system of pension;first of all,we should clearly understand the realistic basis of the legal system of pension in our country.What’s more,have in depth analyses of the current situation of the legal system of pension.In addition,introduce the mature legal system of pension around the world,which gives us important reference and revelation.Last but not least,the part focuses on how to perfect the legal system of pension in our country.In conclusion,the family pension mode would be the basis of our country’s endowment pattern for a long time.The social pension would be the main mode of endowment pattern in the future.So we should accelerate the speed of the legislative processes of the social pension.
