Responsibility For Loss Of Friendship

China since ancient times is formal state, friendship behavior in this human society is variety. Friendship behavior is first proposed by German case theory, the case of human damage caused by the friendship behavior are also rich in the civil judicial practice in our country, the theoretical study of this problem is quite necessary. Author combining the basic theory of civil law, in the existing results, author induce knowledge and further thinking, on the basis of the definition and classification of the friendship behavior by different scholars, analysis of the establishment of the friendship behavior and definite it. Secondly the author analyzes the nature of the friendship behavior and how it convert, the right of claim of human damage. Finally, the author analyzes the tort liability by the friendship behavior, including the elements of the constitution, the principle of the rules and the use of the rules, and the use of the reduction and exemption. I hope this article can provide valuable reference for the judicial practice in the future.
