Legal Protection Of Financial Consumers' Security Rights

On March 5, 2014 new revision of the “consumer rights and interests protection act” is carried out formally in our nation and the financial consumption of the consumers’ rights has been added into the system for the first time. As a basic law to protect consumers’ rights, the part about consumers’ basic rights is the key of the whole law. And with the protection of financial consumers into a new ideological trend, financial consumer’s safety guarantee rights have become a building of the whole financial consumer rights protection system in China. But for the concept, how to guarantee the content of the financial consumer safety, how to realize the protection effectively and other issues are pending; it will be what this paper discusses.This paper is divided into the four parts: the first part is to discuss the related concept of financial consumer rights. Which includes not only the definition of the financial consumer disputes, also contains the analysis of the financial consumer right to security restrictions, the concept and connotation of the expansion, in order to carry out in-depth discussion of the theory of financial consumer security rights protection. The second part is the study of financial consumer protection theory, through the analysis of the theoretical basis for the security of financial consumers’ right protection, highlights the necessity of protecting the right of security. The third part introduces foreign and the Taiwan area about financial consumer rights protection experience. Including the current foreign financial consumer asset security measures, the core content of the legislative level, organization level of protection, aspects of the financial consumer education level and the specialized level disputes; the fourth part combined with the present situation of our country, through the review of the current financial consumer rights to safety problems, ways on China’s financial consumer rights protection in the exploration and design, attempts from the system, consciousness, supervision and other aspects of all-round, multi-angle to build perfect our financial consumer security rights protection system.
