| Due to historical reasons in China and the land reform and other issues, the forest property right is not perfect in the legal system, resulting that there’s no relevant laws at present in our country could perfectly and definitely define forest right, and a lot of forest right attribution blurred. But along with the development of Chinese economy, great change haven taken place in land value, so many people became rich overnight, "Variable phoenix fly on its branches" phenomenon became common. Under this social phenomenon and the interest drive, forest right problem is more and more acute, relevant forest right dispute happened more.This paper, I aim to three cases, exploring the forest right dispute problem now in China. I read a lot of books about how national law deal with forest right dispute, and in this three forest right disputes, for example, including ownership and transfer dispute cases, through the theory with practice, found the problem, careful analysis, finally find out a solution to the problem. Essentially explore the cause of the problem, through analyzing and thinking, seeking for a better way to solve forest right dispute for our country, and put forward reasonable and perfect recommendations, and also conform to the practice in our country. |
