Public Domain Protection In Intellectual Property Law

With the advancement of knowledge and technology, intellectual property system pay more attention to protect the individual right the system itself has a public and social unnoticed. Intellectual property system and the public sphere systems complement each other, protecting the public domain can provide a source of knowledge innovation, it can also safeguard the public interests of knowledge product. From the perspective of the protection of the public domain and analysis of the intellectual property system, we can fully justify its basic social value attributes.This paper discussed the scope of the public domain, and from different perspective to verify the legitimacy, rationality and necessity of the protection of intellectual property in the public domain. Hoping from the institutional perspective, exploring the expansion of rights in intellectual property and the protection of public domain in this information age. And thus improve our intellectual property system.
