Many procedural problems of "Zhejiang Zhang’s uncle and nephew case" eventually led to the tragedy. Procedural problems and serious negative impacts reflected from the case is becoming the focus of social concern. The paper takes Zhejiang Zhang’s uncle and nephew case as an example, analyses the problems exist in the proceeding of the case, torture, lack of powerful supervision, illegal use of illegal evidence and improper complaint channels, from the aspects of subjective and objective and from the aspects of investigation, examination, trial, defense, use evidence to find the causes of problems. The article introduces the legislative achievements overseas, discusses that we should set up correct justice idea, regulate the behavior of the judges, improve the personnel quality and straighten out the relation among the public security, procuratorate, and the court and other prevention countermeasures of procedural problems, so as to find the effective ways to reduce the wrong cases, maintain the social stability, realize fairness and justice, and set up the judicial authority.
