In the age of the Internet shopping, according to the new situation and new problems existing in online shopping, the law of protecting the consumers’ rights and interests(hereinafter referred to as the " xiao fa ") specifies the system of the right of "regret" in the network shopping, however, it needs a series of supporting in its implementation, there are still exist many disputes especially in the exercise of the right of "regret" and so on many aspects, for example, how to definite the behavior of the abuse of right of "regret", the scope of the restrictions and penalties, in the case of the consumer can’t find the seller, the rights and interests of consumers how to maintain, responsibility and decide how to return a large number of civil legal problems of freight shall be borne by the who, become the main part of "shopping" dispute.The so-called "right of regret", is the law give consumers a kind of right, refers to after the consumers in the purchase of goods, if "regret" for their own consumption behavior, can be within the reasonable time stipulated by the law, according to consumer’s idea, return the goods to the seller, and do not need to explain the reasons, also do not need to pay any fees. " Right of regret" is designed for customers to build a "cooling-off period", after the purchase of goods the consumer can have a period of time to consider their consumption behavior make more rational judgment, and have the right to request the return of the behavior, in order to protect the legitimate rights and interests of consumers.This thesis tries to start from the perspective of the "xiao fa" and other relevant legal provisions, combined with the instance, through the legal analysis point to these problems appeared in the "online shopping", and basing on this, discuss the essence of the legal issues of "right of regret" under the "online shopping", put forward my own understanding of the related law issues of " right of regret " in the online shopping, for example: the concept of " right of regret ", properties, etc.; The specific regulation of " right of regret "in e-commerce, for example: some legal regulation for buyers abuse the "right of regret", etc.; For the perfection of the system and other related issues, such as: from what respect to carry on the legislation, how to set up the system of guarantee system of right of "regret”, and so on, puts forward some Suggestions of my own.
